Beginning July 1, 2026, it is illegal to knowingly report a false crime, including child abuse. If convicted, the court can fine you up to $5,000, jail you for up to one year, or both. The court can also order you to repay reasonable investigation or prosecution costs to police or child protection. Cases can be brought by the Attorney General, a county attorney, or the district attorney where the child or the subject lives.
Beginning July 1, 2026, anyone who reports suspected child abuse or helps with the case in good faith is presumed to act in good faith. They are immune from civil or criminal liability. This covers people like doctors, teachers, nurses, social workers, child‑care staff, ministers, and police.
Starting July 1, 2026, a report is false when it lacks credible evidence and the person knew it was false. For child-abuse reports, the same rule defines a willful false claim. If you reasonably relied on credible evidence or credible information when you reported, that is a defense. These rules apply to crime and child-abuse reports.
