The county can create a utility district to run the Choctaw sewer system. Once created, the district has the only local authority to operate, fix, and improve the system and can hire contractors. The county appoints 3 to 5 commissioners; first terms are 2 years, later terms are 5 years. The district does not need a Public Service Commission certificate to run the existing system. The district can charge user fees and, if the creation resolution authorizes it, may levy a local tax or assessments under state law.
The county can use general funds and grants to repair and improve the Choctaw sewer system. If the district is created, the county can transfer pipes, land, easements, and money tied to the system to the district. After the transfer, environmental permits move to the district, which takes over compliance. These steps help keep service going and finish needed work.
If you are 60 days behind on sewer fees, the district can have your water shut off through an agreement with your water provider. The district must give notice. You can be reconnected after you pay what you owe and any reasonable disconnect or reconnection fees. The district can make you repay fees it pays to the water provider.
