Tax credit for small employers offering ICHRA

Starting January 1, 2026, small employers with fewer than 50 employees can get a state income tax credit for offering an Individual Coverage Health Reimbursement Arrangement (ICHRA) instead of a traditional group plan. In the first taxable year they offer an ICHRA, the credit is up to $400 per covered employee, if their ICHRA contribution at least matches the prior year’s benefit level or per-person amount. In the second taxable year, the credit is up to $200 per covered employee if they keep the ICHRA. Employers must be subject to Mississippi income tax.

Caps and filing rules for ICHRA credit

Starting January 1, 2026, an employer cannot use more ICHRA credit than its Mississippi income tax bill. Any unused amount carries forward for up to 10 years. The state can approve no more than $1 million in credits each fiscal year, first-come, first-served, so late filers may get none. Employers must claim the credit on the annual return and provide records the Department of Revenue requires. Any employer that claimed the credit must report every three years whether it kept the ICHRA and what benefits it provided. The Department sets rules to run the program.
