Beginning July 1, 2026, some people seeking post-conviction relief must get permission from the Mississippi Supreme Court before filing in the trial court. This applies if your conviction was affirmed on appeal or the appeal was dismissed. It also applies if a prior post-conviction denial was appealed and affirmed or dismissed, or if more than three years have passed since the time to appeal your judgment or conviction. You must present your motion to a quorum of the Justices and receive an order allowing the filing. The process follows Mississippi Code Section 99-39-27.
