State can claw back incentives for violations

Before the state awards an incentive, it signs a separate agreement that lets the state recover the money if the employer breaks these rules. If the incentive is $5,000,000 or more, the agreement lasts 20 years. For smaller incentives, the agreement must last at least the minimum term the state requires. During the agreement term, anyone can report a suspected violation to the Mississippi Attorney General. If a violation is found, the state can move to recover grant funds. Refusing to provide a written statement counts as a breach of the agreement.

New union limits for incentive-backed employers

Beginning July 1, 2026, employers that take a Mississippi state incentive for a project must follow new union and privacy rules on that project. They cannot recognize a union based only on signed cards when a National Labor Relations Board secret-ballot election can be held. They cannot share a worker’s home address, personal cell number, or personal email with a union without the worker’s written consent, unless a law requires it. They cannot sign a neutrality agreement. They also cannot force subcontractors to do any of these banned actions. These limits apply only to the specific incentivized project, not to other company operations.

Rules start July 1, 2026 for new deals

The law takes effect July 1, 2026. It does not change any agreement signed before July 1, 2026, either between the state and an employer or between an employer and a union. The rules apply to any agreement, contract, or memorandum of understanding that is signed, renewed, or changed on or after July 1, 2026.
