Energy rules for new and renovated buildings

The Mississippi Development Authority adopts the state energy code using ASHRAE 90.1-2016. Beginning July 1, 2013, covered buildings must meet these standards when designed, built, or altered. A "building" means any structure with heating, cooling, or hot water systems. Examples include offices, schools, stores, hotels, and state or local buildings. A building is exempt if its peak energy use is under 3.4 Btu per hour per square foot or under 1.0 watt per square foot. Also exempt: buildings not heated or cooled by fuel, mobile homes, privately owned noncommercial buildings unless they conflict with federal law, and U.S. government buildings. These rules can raise design costs but lower future energy bills.

Local enforcement and $150 inspection limit

Local governments enforce the state energy code and may set penalties. They may charge for thermal and lighting inspections, but no more than $150 per inspection. The Mississippi Development Authority does not enforce these rules. For state-owned buildings, the Department of Finance and Administration ensures compliance.

Energy code extended through 2029

This act takes effect June 30, 2026. The energy standards section remains in force until July 1, 2029. This keeps the current requirements and protections in place through that date.
