30-day hold and hearing in child support

Beginning July 1, 2026, MDHS holds intercepted gaming money for 30 days. After 30 days, it releases the money to the person owed support unless the obligor asks for a hearing in writing before the 30 days end. A timely hearing can pause release. The hearing is limited to identity mistakes or mistakes in the arrears amount. All procedures must be in place by January 1, 2027.

Casinos take winnings for child support

Beginning July 1, 2026, MDHS gives casinos a daily list of people who owe child support. If you win reportable cash gaming winnings or a progressive slot annuity and you owe arrears, the casino must take the arrears before paying you. It sends the withheld amount to MDHS within 7 days and pays you any money left. If nothing is left, you get no payment. If a casino checks and you do not owe, it does not need to check again for you for 24 hours. These rules apply only to winnings that require a W-2G (or similar) tax form. All detailed rules and processes must be in place by January 1, 2027.

Rules, fees, and protections for casinos

Beginning July 1, 2026, casinos can keep an administrative fee up to $35 from each qualifying payment, starting with the second payment for annuities. Casinos and their staff are protected from lawsuits or charges when they follow MDHS information and this law. The Gaming Commission must set rules with MDHS and require procedures to prevent workers from willfully skipping withholding. All required rules and procedures must be in place by January 1, 2027.
