Beginning July 1, 2026, a licensed agent can show you a home without a signed buyer-broker agreement. You can attend open houses without signing anything. A seller’s agent may also present your offer without a buyer agreement if they only represent the seller and get no pay from you. These rules apply to one- to four-unit homes handled by licensed brokers or salespeople.
Beginning July 1, 2026, a broker must have a written agreement before listing your home or submitting an offer for pay. The agreement must state the services and how the broker and licensees are paid. You choose the type of brokerage service by signing the agreement. This applies to one- to four-unit residential sales handled by licensed brokers or salespeople.
Beginning July 1, 2026, these rules cover only homes with one to four units or similar residential co-ops. They apply only when a licensed broker or salesperson handles the deal. They do not cover transfers by court order, foreclosures or deeds in lieu, bankruptcy trustee sales, estate or trust fiduciary transfers, co-owner transfers, transfers to a spouse or lineal relatives, divorce or separation property transfers, transfers to or from government, or land with no dwelling. If your transfer is in these groups, the showing and agreement rules do not apply.
