Opioid settlement fund set up and protected

The law creates the Opioid Settlement Fund in the State Treasury. The Attorney General deposits settlement money after attorney fees and expenses are paid. Unspent balances do not lapse and earn interest that stays in the fund. When the law takes effect, the state moves all money from Fund No. 3308900000 into the new fund and closes the old account.

Rules for spending settlement dollars

Abatement funds can be spent only after the Legislature appropriates them and must follow settlement terms. The Attorney General oversees abatement spending to ensure compliance. Nonabatement funds also require legislative appropriation, and the council does not make recommendations on those dollars.

Advisory council structure and safeguards

The law creates the Mississippi Opioid Settlement Fund Advisory Council in the Attorney General’s office. Voting members include the Attorney General (chair), health and mental health leaders, and appointees from the Governor, legislative leaders, courts, education, and local groups. Many nonvoting advisors from justice, health care, Medicaid, treatment, and community organizations also serve. Appointments are due within 60 days; the first meeting is within 90 days. Terms run three to four years, and members must recuse if their organizations may benefit. Members serve without pay but can be repaid for necessary expenses from the fund. The council ends when all settlement money is received and spent, unless more funds are expected within a year.

Grant priorities and lawmaker decisions

Each year, the council publishes grant priorities and application rules. It reviews all qualified applications and cannot exclude qualified applicants from the list. At least 30 days before the Regular Session, it sends a prioritized list with reasons to state leaders. Lawmakers then decide which recommended applicants get money and how much, by separate line items.

Online grant system and public reporting

Within 60 days of the law’s effective date, the Attorney General must hire a qualified third party using nonabatement funds. The contractor builds an online grant portal, helps applicants, scores proposals, and administers payments under appropriation bills. It tracks outcomes and posts a public data dashboard with quarterly updates on the Attorney General’s website. By November 1 each year, the council files an annual report on deposits, balances, spending, and results, which is posted online. Within 45 days after a session that appropriates settlement funds, the Legislative Budget Office reports the amounts to the Attorney General.
