Foreign lawsuit funders must report to Attorney General

Beginning July 1, 2026, foreign third‑party litigation funders must report to the Mississippi Attorney General. The rule applies when they fund lawsuit costs or potential loss payments and their money includes a foreign entity of concern. They must disclose the name, address, and citizenship or incorporation country of any such foreign entity with rights to outcome‑based payments in the case or a portfolio of cases. They must also identify any such foreign entity that received or can receive proprietary or national‑security‑related information through the funding deal. They must provide a copy of any agreement that creates an outcome‑based payment right. Disclosures are due within 30 days after the agreement or the lawsuit filing; if the agreement comes after filing, within 30 days after service. This does not cover information held by a party, the party’s counsel of record, or the law firm of record.

Who is covered by reporting rule

The law defines who is covered and who is not. A foreign entity of concern includes groups tied to a foreign country of concern, or on U.S. terrorism or sanctions lists. A foreign person includes certain non‑U.S. citizens, associations, and corporations from those countries. A third‑party litigation funder is someone who pays case costs in return for payments tied to the outcome. The law excludes parties and law firms of record, non‑contingent lenders, health insurers and medical providers paid for care, living‑expense funders, and some nonprofits seeking only injunctions or declarations. These definitions apply starting July 1, 2026.
