Beginning January 1, 2026, if a partnership, LLC, or S corporation earns this credit, the owners split it. You can divide it by ownership share or by a written agreement among the owners.
Beginning January 1, 2026, people who are not business taxpayers can claim this donation tax credit. You can use it to lower your Mississippi income taxes or up to 50% of your real property taxes each year. You can use no more than 50% of your total state tax bill or 50% of your property tax bill, and you can carry unused credit forward for five years. You cannot also take a Mississippi state income tax deduction for the same donation. To use the credit on property taxes, show Department of Revenue paperwork to your tax collector; the collector applies the credit and the state reimburses the collector.
Beginning January 1, 2026, you apply on state forms and state how much you plan to give. The Department of Revenue allocates credits within 30 days; if the annual limit is tight, you may get a partial allocation. If you receive an allocation for a planned gift, you must donate within 60 days or lose it. The statewide cap is $10 million each year, and no more than 25% can go to one charity; after June 1, any unused credits can go to any charity.
Beginning January 1, 2026, only 501(c)(3) pregnancy resource or crisis centers in Mississippi that meet strict rules qualify. They must spend no more than 20% of credited donations on administration, keep a Mississippi office, and not refer for or fund abortions or abortion‑inducing drugs. They must certify under penalty of perjury, keep government funding under 50% of annual revenue and avoid certain federal funds, and serve Mississippi residents. The Department of Revenue reviews certifications and posts a public list you can check before you give.
