Moss Point can add a local tax of up to 2% on prepared food sold by restaurants. Restaurants may add this charge to your bill. The money must fund tourism and parks and recreation, not the city’s general fund. This authority ends on July 1, 2030.

Restaurants must collect and pay the tax

If you operate a restaurant in Moss Point, you must add the tax to the price and collect it at sale when practical. You must file and pay the tax to the Mississippi Department of Revenue using the same process as state sales tax. The department enforces the rules and sends the net money to the city by the 15th of the month it is collected.

Local vote and audit rules for the tax

Before the city can start the restaurant tax, voters must approve it by at least 60%. The city must publish notice weekly for three weeks: first at least 21 days before the vote and last no more than 7 days before. If approved, the tax starts on the first day of the second month after the vote. The city may not use public funds to promote the vote, and city employees may not promote it during business hours. The city must notify the state revenue commissioner by the 15th day of the month before the tax starts. The city must keep these funds in a separate account and get a yearly CPA audit.
