Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 2 costs, 1 mixed.

Up to 2% tax on Vaiden dining

The Town of Vaiden can add a local tax of up to 2% on restaurant food and drinks. You pay up to 2% more on your bill if the town adopts it. The town must pass a resolution, hold an election, and at least 60% of voters must approve. It must publish notice once a week for three weeks: first at least 21 days before the vote and last no more than 7 days before. This authority ends July 1, 2030, unless renewed.

Restaurants must collect Vaiden tax

When the town imposes the tax, restaurants in Vaiden must add it to each bill and collect it at the time of sale. The Mississippi Department of Revenue collects and enforces it like the state sales tax. Before the tax starts, the town must notify the Commissioner by the 15th of the prior month and send a certified resolution at least 30 days before the start date.

Tourism and parks fund with audits

After keeping any allowed amount, the state sends the tax money to Vaiden by the 15th of the next month. The town must place the money in a separate fund and spend it only on tourism and parks and recreation. The town must keep separate books and get a yearly independent CPA audit; the audit is paid from the fund. The town can end the tax by resolution, effective the last day of the month. This act replaces a 2018 local law that had expired.
