Highway right-of-way limits and deadline

Beginning July 1, 2025, after the transportation department files a right-of-way plan for a highway, it does not pay for buildings, improvements, or subdivisions added after that filing. This rule does not apply to crops or similar plantings. A filed highway location lasts only one year if the state does not start buying or condemning the property. After one year with no action, the established location no longer binds your land.

Clearer right-of-way plans and deeds

Beginning July 1, 2025, the transportation department must file a detailed right-of-way plan for new or rebuilt highways and for roads made controlled-access. The plan shows the centerline, width, property lines, owner name, the part in the right-of-way, a parcel number, and the project number. For deeds to or from the state, listing the project number, parcel number, and the section or lot counts as a valid legal description. This helps property owners see if their parcel is affected and simplifies closings with the state.
