Homeowners get no pay for post-plan builds
Beginning July 1, 2025, once the Transportation Department files a right-of-way plan that covers your land, you cannot get paid for buildings, improvements, or new subdivisions you add after that filing. This rule applies if the state later buys your land or takes it through condemnation. Crops and similar improvements are not included here and are valued under 70-30-302.
Transportation Department must file right-of-way plans
Beginning July 1, 2025, the Transportation Department must file a right-of-way plan when it sets the location or width of a new or rebuilt highway, or makes a road controlled-access. The plan shows the centerline, highway width, the boundary lines of each private property crossed, the owner’s name, the part included in the right-of-way, a parcel number for that part, and the project number. Deeds that use the plan’s project and parcel numbers count as valid legal descriptions in state deals. If the state does not start to condemn or acquire within one year of filing, the set highway location under the plan is no longer in effect.
