Homeowners’ associations must ask before entry

The law requires a homeowners’ association to get your permission before entering your property. When asking, it must set a convenient date and time and say which area it needs to access. You may require that you or your agent be present during entry. This does not change the public’s implied right to use sidewalks, front paths, or approach your front door. It applies to formal homeowners’ associations with covenants or bylaws that can levy assessments and enforce rules. The rule does not apply to condos where bylaws cover entry to reach common elements, or to easements of record that benefit the association.
