You can change your lawyer in a court case or special proceeding at any time, even after judgment. You can do this by filing a consent signed by you and your lawyer with the clerk or put it on the record. Or you can ask the court to order the change after you or your lawyer give notice to the other. These rules do not apply when the Office of State Public Defender assigns or reassigns a lawyer under the Montana Public Defender Act; that Office’s rules control.
