Medicaid rates follow Medicare updates

The health department may set Montana Medicaid payment rates using Medicare fee schedules from CMS. When it does, CMS changes during the year apply automatically. These automatic updates are exempt from some state notice-and-comment steps. This speeds provider payment changes and can affect which providers accept Medicaid.

More transparency in state rulemaking

Agencies must state in each proposal notice when and how they contacted the bill’s primary sponsor; without it, the filing is ineffective. Agencies must email the notice the same day to the rule review committee and send the published notice to the primary sponsor within 3 days. With a person’s consent, agencies may send an email link instead of a full copy of notices and must keep an interested-persons list. When a proposal changes fees, costs, or benefits, the notice must state the estimated total dollars affected and how many people are affected, if known. If an adopted rule does not use the sponsor’s earlier comments, the agency must explain why.
