In Montana, state agencies and private companies cannot use ADS-B In or Out data to set or collect fees from small plane owners and operators. This applies to flights within Montana in aircraft that weigh 9,000 pounds or less. It applies when the flight is under 14 C.F.R. part 91 (general aviation rules). The ban is limited to fees based on ADS-B data.
