State review and fees for nuclear projects

Applicants to the Federal Energy Regulatory Commission or the Nuclear Regulatory Commission must send DEQ a notice and a copy of the federal application. Applicants must pay a DEQ fee when they file the federal application. The fee funds DEQ’s state recommendation and participation in federal proceedings and cannot exceed one‑half of the amount allowed under 75-20-215. DEQ cannot also charge the 75-20-215 fee to the same applicant. DEQ files a formal state recommendation with the federal commission. If an applicant’s late or missing notice prevents timely state compliance, they face enforcement under 75-20-408.

Rules for on-site nuclear waste storage

The law allows temporary storage of spent nuclear fuel only at a Montana nuclear power plant site. The fuel must come from a nuclear plant operating in Montana. The Department of Environmental Quality (DEQ) must issue a state recommendation under 75-20-204. The federal Nuclear Regulatory Commission must license construction and operation. The law also defines “spent nuclear fuel” as fuel used in a reactor that can no longer sustain a reaction.
