New filings, fees, and penalties for applicants

If you apply to the Federal Energy Regulatory Commission or the Nuclear Regulatory Commission for a covered facility, you must also file a notice and a copy with Montana DEQ. You must pay a DEQ fee at filing so the state can prepare its recommendation and join the federal case. The fee cannot be more than half of what DEQ could charge under 75-20-215, and you will not be charged that other fee too. If you file late and delay DEQ’s work, you are subject to penalties under 75-20-408.

Rules for on-site spent fuel storage

The law requires legislative approval before siting any temporary spent nuclear fuel storage tied to a Montana nuclear plant. A site is allowed only on plant property, and it may store only fuel made by a plant operating in Montana. The facility also must have a DEQ state recommendation and a federal license from the Nuclear Regulatory Commission. DEQ must send its recommendation to the proper federal agency and take part in that review. The law takes effect on passage and approval.
