Subdivisions near lines must use public water and sewer

The law requires some new subdivisions to connect to public water or sewer. This applies when the subdivision requests service and a boundary is 501–1,000 feet from any part of a qualifying public system. County and city systems must provide service if the system is state‑approved and the manager certifies capacity, authorized connections, regulatory compliance, and a valid water right. DEQ must adjust its rules so connection is the required method in these cases. The act is effective on passage and approval and applies to subdivisions under state subdivision review (Title 76, chapters 3 or 4).
