State and local building departments do not have to analyze greenhouse gas emissions for certain products and appliances. This applies when they adopt or enforce state or local building codes. The covered items are those in federal law (42 U.S.C. 6292). The department also does not have to analyze greenhouse gas emissions that occur outside Montana for some federally regulated sources. This includes new motor vehicles and engines (42 U.S.C. 7543(a)) and new nonroad engines and vehicles (42 U.S.C. 7543(e)(1)).
