Faster Medicaid settlements for critical access hospitals

The law aligns Montana Medicaid cost-report settlements with Medicare for critical access hospitals. When Medicare’s contractor gets a cost report, the department makes a tentative retroactive adjustment and accepts reported costs unless there are obvious errors. The department completes an interim settlement within 240 days of that receipt, or pays within 30 days after it gets the contractor’s interim Medicaid settlement, whichever is sooner. After the contractor’s final desk review or audit, the department makes a final adjustment. If an overpayment is found at interim or final, the hospital has 60 days from notice to repay or set a plan. If an underpayment is found at final, the department pays within 90 days.

Funding and deadlines for old cost reports

The law also applies to cost reports filed before it took effect. The department must settle those older reports within 240 days of the effective date. For the year starting July 1, 2025, it provides $33,900 from the state hospital Medicaid account and $33,900 in federal funds. For the year starting July 1, 2026, it provides $7,500 state and $7,500 federal to run these settlements. The law takes effect on passage and approval and must meet federal CMS requirements. The legislature also intends $15,000 state and $15,000 federal for the two-year period to be part of the next base budget.
