Local governments in Montana cannot create, adopt, or enforce extreme risk protection orders. They also cannot accept grants or other money to help adopt or enforce these orders. An extreme risk protection order is an executive or court order that blocks a person from owning or getting a gun or requires surrender; it does not include orders under Title 40, chapter 15. Each enforcement or attempted enforcement is a separate offense, and a violating local government can be fined up to $10,000 per offense, paid to the state general fund. The law also adds this ban to the list of powers denied to local self-government units.
