New rules for motor carrier certificates

Beginning July 1, 2025, the commission must set a hearing within 90 days after it gets a protest or hearing request. This replaces the old 60-day setting rule. For applications under 69-12-311(1)(a) or by Class E carriers, protests can only challenge whether the carrier meets the fitness requirement in 69-12-323(5). For applications under 69-12-311(1)(b) or by Class D carriers, the commission may deny a certificate without a public hearing if a past public investigation on the same route found the service was not needed. A hearing is held if the applicant shows facts that conditions have materially changed since that finding. These changes can narrow protests and speed some cases, but they can also delay hearings and make approval harder in areas already reviewed.
