Tougher sentences for abuse in care facilities

The law adds 1 to 10 years in state prison on top of the original sentence. It applies when a worker or volunteer in a caregiving facility is convicted of a Title 45, chapter 5 misdemeanor or any felony against a vulnerable person in that same facility. The extra time must run after the first sentence, not at the same time. Judges cannot defer or suspend the minimum extra term, except as allowed in 46-18-222. This covers places like assisted living, nursing homes, mental health centers, day care centers, schools, group homes, foster homes, and halfway houses. A vulnerable person is a child, a vulnerable adult, or an incapacitated person. This applies when the notice rules in 46-1-401 are met.
