Mine operators must meet silt pond capacity

Mine operators must build each siltation pond to the design capacity set in state rule and the approved reclamation plan. A qualified registered engineer must certify the structure. If a series of storms exceeds that capacity, operations remain compliant if the operator restores capacity as soon as weather and ground conditions allow. This rule also applies to siltation structures built before mining starts.

Mining law in effect now; federal check

The law takes effect upon passage and approval. If the U.S. Secretary of the Interior disapproves any part under 30 CFR 732, that part is void. The Department of Environmental Quality must notify the code commissioner within 15 days after the federal disapproval takes effect.
