Harsher sentences for gang felonies

Beginning December 1, 2026, if a felony (not Class A, B1, or B2) is found to be part of criminal gang activity, the sentence increases by two felony classes. If the person is a gang leader or organizer, the sentence increases by three classes. These enhancements apply to offenses committed on or after that date.

New gun felonies for gang members

Starting December 1, 2026, a gang member who uses or carries a gun during a serious felony, drug crime, or crime of violence commits a Class G felony. It is a Class F felony if the gun is brandished and a Class D felony if the gun is fired. A gang member who transfers a gun to someone they know or reasonably believe is under 18 commits a Class G felony.

Broader gang definitions and trial rules

Starting December 1, 2026, the law broadens who counts as a criminal gang, a member, or a leader. Gang cases can be tried in any county where any part of the gang activity happened. Courts may use fact or expert witnesses to explain gang membership, conduct, customs, and likely crimes. Prosecutors must give the defense their gang‑activity evidence or a summary at least 10 days before trial, unless a judge shortens the time for good cause.

Higher court costs and tighter waivers

Beginning December 1, 2026, district court costs rise to $177.50 and superior court costs rise to $184.50. The State Treasurer sends $0.95 from each fee to the North Carolina State Bar. Courts can waive fines or costs only by a written order with findings of fact and conclusions of law showing just cause. Courts must mail at least 15 days’ notice to affected government entities and let them be heard before any waiver.
