The law requires a public hearing before any agency condemns or rezones qualifying farmland in a voluntary or enhanced agricultural district. The local agricultural advisory board holds the hearing and sends written findings and a recommendation within 30 to 45 days after the request. An agency cannot formally start condemnation or rezoning while the case is before the board during that time. After the board submits its findings, the agency must wait 120 days before taking action. Beginning October 1, 2025, these rules apply to actions started on or after that date.
