AN ACT DEFINING CARE AND MAINTENANCE OF CEMETERIES LICENSED BY THE CEMETERY COMMISSION, AUTHORIZING THE CEMETERY COMMISSION TO PROMULGATE MINIMUM STANDARDS FOR THE CARE AND MAINTENANCE OF CEMETERIES AND IMPOSE PENALTIES FOR VIOLATIONS OF THOSE STANDARDS, AND REQUIRING ANNUAL FINANCIAL REPORTS TO INCLUDE DETAILS OF THE CARE AND MAINTENANCE PERFORMED AT CEMETERIES.

Upkeep standards and fines for licensed cemeteries

The law defines the care work licensed cemeteries must do, like cutting grass, raking and sodding graves, pruning trees, and fixing walks and buildings. The Cemetery Commission sets minimum upkeep standards and can investigate complaints. If a cemetery violates a standard, it gets at least 10 days’ written notice and 20 days to fix it. The Commission can fine $50 for each day the problem continues, and unpaid fines due within up to 30 days can be collected in court. At sale, cemeteries must give buyers a written trust statement and file a care report within 60 days after each year using Commission forms. These rules take effect July 7, 2025.
