New upkeep rules and fines for cemeteries

Beginning July 7, 2025, cemeteries licensed by the North Carolina Cemetery Commission must meet defined care and maintenance duties. These include cutting grass at reasonable times; raking, cleaning, filling, seeding, and sodding graves; pruning or removing trees and shrubs to keep access; and repairing enclosures, buildings, drives, walks, and memorial gardens. The Commission sets minimum upkeep standards and can enforce them after an investigation. It can fine licensees $50 per day for violations, and each day counts as a separate offense. Before a fine, the Commission must give at least 10 days’ written notice and allow 20 days to fix the problem. If unpaid, the penalty can be collected as a debt after up to 30 days.
