Homeowners association rules can still block home businesses

Private land‑use rules still apply. If your deed or homeowners association bans home businesses, this law does not change that. Those private rules can still stop you even if the city allows a no‑impact home business.

No-impact home businesses face fewer city rules

If you run a qualifying “no-impact” home business, the city cannot ban it. The city also cannot make you get a permit, license, variance, or registration, or force you to rezone to commercial use or install fire sprinklers under the North Carolina Residential Code. To count as “no-impact,” people on site stay within the home’s occupancy limit; you sell only legal goods or services; you do not create on‑street parking or big traffic; work happens inside or in the yard and is not visible from the street; and you do not store merchandise or equipment outside. Cities can still set narrow health and safety and neighborhood‑fit rules and may bar adult‑oriented or similar businesses.
