Local officers: choose separation pay

Starting July 1, 2025, local law enforcement retirees can choose how their special separation allowance is calculated. Choose 0.85% of your most recent base annual pay times your creditable years, or 0.85% of the pay you had when you reached 30 years times 30. You must be under 62, have at least five years of continuous law‑enforcement service before retirement, and meet service rules (30+ years, or age 55 with 5+ years; for the 30‑year method, at least half your service is as a law officer). The election is one‑time before the first payment; if you do not choose, the pay‑at‑30 method applies. Payments follow your employer’s payroll and end at 62 for method 1, or last from your 30‑year date until age 62 for method 2.

State rehire can stop payments

Beginning July 1, 2025, if you retire from State law enforcement and get the special separation allowance, payments stop on the first day you are reemployed by any State department, agency, or institution. Payments can continue only if you return to a State job that is exempt from the North Carolina Human Resources Act and it is in a different agency than the one you retired from.

Rules start July 1, 2025

The law takes effect July 1, 2025. It applies only to law enforcement officers who retire on or after that date. Officers who retired before July 1, 2025 are not covered.

Some local jobs keep payments

Starting July 1, 2025, some local rehires can keep getting the special separation allowance. Payments do not stop if you take a public safety job that does not require the Local Governmental Employees’ Retirement System (LGERS). Payments also do not stop if you work for a county board of elections on election day or during early voting, in a role allowed by G.S. 128-21(19) that does not suspend LGERS benefits.
