Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Single license to work across states

North Dakota adopts the Social Work Licensure Compact. Your home-state board issues one multistate license (bachelor’s, master’s, or clinical) that lets you practice in other member states. You must have an active, unencumbered license, pay fees, give fingerprints, report discipline within 30 days, and meet continuing competence. Bachelor’s and master’s licenses require the degree in social work and a qualifying national exam (or approved equivalency). Clinical licenses also require a master’s degree and at least 3,000 supervised hours or two years full-time. The compact takes effect when seven states enact it.

Commission runs the interstate license system

The law creates a commission to run the compact and make rules with the force of law unless a court finds a conflict. The commission builds a shared licensing and discipline data system for member states. Meetings are public, with limited closed sessions for legal advice, investigations, and similar matters. The commission can address state noncompliance and end a state’s membership after notice and a chance to fix problems; a terminated state must still recognize compact licenses for at least six months after notice. Commission members and staff have legal protections for actions within their duties.

Discipline can pause your multistate practice

If you hold a multistate license, a remote state can remove your authorization there, fine you, and act to protect public safety under its laws. If your multistate license is encumbered, your ability to practice in other member states is deactivated until you clear the issue.

Costs and steps for multistate license

The home-state board may charge a fee to grant a multistate license, and the interstate commission may also charge licensees. Applicants must give fingerprints or other biometrics for FBI and state criminal checks. When you move your home state between member states, you must apply right away for reissuance in the new state and notify the old state. You must pay any fees, and the new state runs a fingerprint criminal-history check. The old multistate license is deactivated after reissue, and member states are notified.
