Stricter enforcement and costs for illegal dams

The law sets a clear process to remove illegal dikes, dams, or devices. After a complaint, the Water Resource Board investigates. If it finds a noncomplying device that holds over 50 acre-feet of water (or 25 acre-feet for a medium- or high-hazard dam), it sends the landowner a certified notice and copies any tenant. The notice explains the violation, gives at least 15 days to remove it, and lets you demand a hearing within 15 days; the Board must set a hearing date within 15 days of your demand. If it is not removed in time, the Board can remove it and assess the removal costs against the property, collected like other assessments; costs can be split among responsible owners or tenants, and a frivolous complainant can be charged. The Board can recover its costs after its own removal or after you comply with a Board order. In an emergency, the Board can go to district court right away to stop construction or order removal.
