DNA collection by police and medical staff

The law spells out who may collect DNA samples. Physicians, registered nurses, licensed practical nurses, phlebotomists, and medical technologists may take blood or other body fluids in a medically approved way. Licensed peace officers and certified correctional officers may take saliva samples. All samples must use kits the laboratory approves and follow the lab’s rules. Out-of-state agency staff may collect and submit samples only if the laboratory approves them. These rules take effect immediately.

Legal protection for DNA collectors

Authorized people who draw or obtain blood or other body fluids for DNA testing are protected from civil and criminal lawsuits. The protection applies only when they use sampling techniques the laboratory approves. These protections take effect immediately.
