Big fines for tank violations

If you break the tank rules, you can be fined up to $12,500 for each day. Each day you violate counts on its own. Knowingly false statements can cost up to $12,500 each. The department can order fixes and take you to court.

Fund help for some aboveground tanks

You can apply to register an aboveground farm or home tank. You can also register an aboveground tank that feeds a diesel generator. If you register, you are eligible for reimbursement from the Petroleum Release Compensation Fund for cleanup and third-party claims. Registration is required to get this help.

Which tanks are covered or excluded

The law defines which aboveground tanks are covered. Many tanks are not covered, like farm or home noncommercial tanks, on-site heating-oil tanks, septic tanks, pipelines, surface impoundments, portable tanks, propane tanks, and tanks at terminals, refineries, or midstream sites. Small lubricating-oil tanks under 1,320 gallons are also excluded. Use your tank’s size, use, and location to decide if rules apply. Some excluded tanks stay outside the program unless you register them to seek reimbursement.

New rules and fees for aboveground tanks

The Department of Environmental Quality runs a new program for aboveground storage tanks and sets enforceable rules. Owners must use leak detection, keep records, report releases, and follow construction, closure, and financial-responsibility rules. The department can mark noncompliant tanks ineligible for delivery. Aboveground tanks must pass integrity tests using Steel Tank Institute SP 001 or API 653. The program can charge permit or registration fees, and inspectors may enter sites and copy records. The department can act fast if a release threatens health or the environment.
