Caps on kinship care and shelter pay

Nonfederal money can pay a relative who is not licensed for up to 6 months. The caregiver must be an identified or kinship relative. Maintenance payments to a guardian are allowed only if the Department approved a subsidy. For certified shelter care, nonfederal reimbursement covers up to 7 days. The Department may extend only if the agency tried to find another placement and the extra time is needed for the child’s health or due to unforeseeable events.

Stronger rules to revoke foster licenses

The Department can deny or revoke a foster care license or certification. Grounds include missing legal prerequisites; false or withheld facts in an application or a license issued on false information; or rule violations. The Department can also act if a family foster provider had a child removed for a contrary-to-the-welfare finding now or within the last 5 years. Relevant convictions, or not being sufficiently rehabilitated under section 12.1-33-02.1, are also grounds.

Only licensed facilities get foster funds

The state can spend public funds on foster care only in facilities the Department licenses, certifies, or approves. Anyone acting for a state, county, or city may not arrange or promote care in unlicensed facilities. This rule applies to children and adults. Homes or institutions run by the state are exempt.
