State disaster fund and fast grants

The law creates a State Disaster Relief Fund. Money in the fund pays the state's share for emergency response, governor-declared disasters, FEMA response, recovery, and mitigation grants, and reimbursements under section 37-17.1-28. Interest earned stays in the fund. Before spending, the agency must share the purpose and payee with the Legislature's appropriation committees, or the Budget Section when not in session. After the Governor declares a disaster or signs a federal disaster agreement, the Homeland Security director records state response and recovery costs. The Governor can ask the State Emergency Commission for a grant up to those costs. When the application arrives, a disaster is conclusively presumed, and the Commission can transfer funds from the disaster relief fund or other approved funds.

State loans to unlock federal aid

With State Emergency Commission approval, the Office of the Adjutant General can borrow from the Bank of North Dakota to match federal aid under the Stafford Act. After the President declares a disaster in a county or counties, the Adjutant General must ask the Commission to approve the loan, add needed staff, and allow spending of state and federal funds, including the disaster relief fund. If approved, the Commission notifies the Adjutant General, the Bank, and the Office of Management and Budget. The Adjutant General must report progress and file a final report when projects end. The Adjutant General must repay the loan with interest. If a balance remains at the end of the biennium, the office must request a deficiency appropriation to repay it.
