Military justice covers ND Guard on duty

North Dakota law now uses the federal Uniform Code of Military Justice and the Manual for Courts‑Martial as of December 31, 2024, unless state law says otherwise. If you commit an offense while on military duty status, including state active duty, you can be tried by a court‑martial even after your duty ends. Punishment follows those federal rules, within limits in state and federal law. Commanders may give nonjudicial punishment under Part V of the Manual, and you cannot demand a court‑martial instead. If the offense also breaks state civil law, the charging officer may turn the case over to civilian authorities.

Civil relief for Guard on 30‑day orders

If you are called or ordered to active service for 30 or more straight days, you get the federal Servicemembers Civil Relief Act protections as of December 31, 2024. These protections are now part of North Dakota law for those orders. They apply while you meet the 30‑day active service requirement.
