Federal methods for milk safety checks

State milk sanitation rating and sampling officers must use federal methods named in law, including “Methods of Making Sanitation Ratings of Milk Shippers 2019” and the 2023 listings for single‑service containers and closures. Sampling follows the Standard Methods. Milk laboratories are evaluated and certified using the Standard Methods and FDA’s “Evaluation of Milk Laboratories 2019–2023 Edition.” These steps standardize inspections and lab testing across the state.

Only Grade A milk may be sold

Only Grade A milk can be sold as a drink in North Dakota. The law sets the minimum standards for Grade A milk and milk products to match the federal Pasteurized Milk Ordinance (2019–2023), including the supplement for condensed and dry milk and whey. In state law, “pasteurized milk ordinance” now means the 2019–2023 federal Grade A PMO issued by FDA and the U.S. Public Health Service. Dairy producers, processors, and manufacturers must follow that PMO and the 2019–2023 NCIMS procedures used for interstate milk shipments. The agriculture commissioner may issue extra rules to protect safety, sanitation, supply, consumer interest, and saleability of Grade A milk.
