AN ACT to amend and reenact sections 4.1-19-03 and 4.1-19-05 of the North Dakota Century Code, relating to the management of eggs and poultry in the state; and to repeal section 4.1-19-04 of the North Dakota Century Code, relating to licensing requirements for buyers, sellers, and producers of eggs and poultry.

Stronger penalties for poultry rulebreakers

Breaking these poultry rules is a class A misdemeanor. Knowingly filing false statements is also a class A misdemeanor. The Agriculture Commissioner or a court can fine up to $1,000 for each violation. Fines can be decided in court or by the commissioner in an administrative hearing with an independent hearing officer. The commissioner can sue violators, and businesses (LLCs, corporations, partnerships, co-ops) count as persons and can be charged and fined.

No state license for egg and poultry sellers

The law repeals the state license for buyers, sellers, and producers of eggs and poultry. Those businesses no longer need that license. This cuts paperwork and any related fees for small farms and shops.

State runs poultry health and grading

The Agriculture Commissioner leads poultry health and marketing work in North Dakota. The office works with the State Board of Animal Health to control and stop poultry diseases. It works with the U.S. Department of Agriculture on the National Poultry Improvement Plan. At retail, the state provides and oversees poultry grading and enforces grade labels on products. The commissioner can adopt rules to carry out these duties.
