Licensing, fees, and penalties for insurance administrators

Administrators of life, annuity, or health coverage for self-funded plans must hold a state administrator license. This includes those who underwrite, collect premiums, or adjust claims for North Dakota residents. Acting without a license is a class C felony. The application requires a $100 filing fee, and renewal costs $50 each year. The commissioner must issue the license unless, after notice and a hearing, the applicant is not competent, trustworthy, financially responsible, of good reputation, or had an insurance license application denied for cause within the last five years. After notice and hearing, the commissioner may suspend or revoke a license and fine up to $5,000 for a suspension or $10,000 for a revocation.

PBMs must have administrator license

Pharmacy benefit managers may not operate in North Dakota unless they hold an administrator license under state law. PBMs must obtain that license before performing PBM services in the state.
