Stronger rail safety rules in North Dakota

The Public Service Commission can adopt and enforce railroad safety rules in North Dakota. It can set stricter rules than federal rules to fix state or local safety hazards. The rules cannot conflict with federal law or create an undue burden on interstate commerce.

Active rail investigations kept confidential

The Public Service Commission limits public access to some records and parts of meetings. The limits apply when they relate to ongoing railroad investigation and surveillance by the National Transportation Safety Board. These items are exempt from disclosure under section 44-04-17.1 while the investigation is ongoing.
