If you first enrolled after December 31, 2019 (and are not a supreme or district court judge or a state peace officer), your service benefit is 1.75% of final average salary for each year of service. State peace officers (not BCI) who first enrolled after December 31, 2019 also earn 1.75% per year; their prior service is paid at 2.00% per year. Prior service benefits for eligible members are 2.00% of final average salary for each year of prior service.
For retirement, a firefighter hired after July 31, 2017 counts only if working at least 32 hours a week and 20 weeks a year. A firefighter employed by the North Dakota National Guard is not treated as a “firefighter” under this retirement law. A firefighter who starts after July 31, 2017 and is in the law enforcement retirement plan cannot be in any other plan run by the system at the same time.
You can get early retirement only after at least three years of eligible work. Judges need at least five years. If you first enrolled after December 31, 2015 and are not in an exempt group (National Guard security officers or firefighters; firefighters, peace officers, or correctional officers of a political subdivision; state firefighters or peace officers; or supreme or district court judges), your early benefit is cut 8% for each year before normal retirement. The cut applies to your accrued single‑life benefit.
If you are a Bureau of Criminal Investigation peace officer in the system, you pay 4% of your monthly salary each month. Your pension is 3.00% of final average salary for each of the first 20 years of service, and 1.75% for each year after 20.
If you are a supreme or district court judge, your pension uses tiers: 3.5% per year for the first 10 years, 2.8% per year for the next 10, and 1.25% per year after 20. You also get 3.5% per year for any nonjudicial employee years. If disabled, your benefit starts at 70% of final average salary, then is reduced by your primary Social Security payments and any workforce safety and insurance benefits.
If you are not a supreme or district court judge and become disabled, your pension pays 25% of your final average salary each year. The system guarantees at least $100 per month. If your calculated amount is lower, you get $100 instead.
Employers of firefighters or peace officers employed by the state, and National Guard security officers, must pay pension contributions the board sets as actuarially required. Payments come from salary appropriations or other available funds. If an employer pays an employee’s assessment, the employer must also pay an equal extra amount.
