AN ACT to amend and reenact sections 26.1-01-07 and 26.1-26-13.4, subsection 4 of section 26.1-26.8-04, subdivision b of subsection 1 of section 26.1-26.8-05, subdivision a of subsection 1 of section 26.1-26.8-06, subdivision b of subsection 1 of section 26.1-26.8-09, subdivision b of subsection 2 of section 26.1-26.8-09, and subsections 2 and 4 of section 26.1-27-03 of the North Dakota Century Code, relating to fees charged by the insurance commissioner.

Refunds for wrong insurance fee payments

If you paid a fee, penalty, or interest that was not due, you can ask the Insurance Commissioner for a refund. You must file your claim within two years of the fee’s due date. The commissioner can pay the refund in cash. The law also removes earlier language that let the commissioner raise fees to meet appropriations.

Higher and unified insurance licensing fees

The law updates and centralizes many insurance filing and license fees. Examples: articles of incorporation $50, certificate of authority $750, annual statement $200, and producer appointment $25. Producers and public adjusters must file a biennial license continuation and pay the fee in the central schedule; the commissioner must give at least 60 days' notice. If a public adjuster’s license lapses, they can reinstate within 12 months by paying a reinstatement fee up to $125 plus the renewal fee. Business entities and administrators also pay application and renewal fees set in the same schedule.
