New crime for posting others' personal data

The law makes it a crime to post someone’s personal identifying information to scare, threaten, or harass a North Dakota resident. It covers the person, their immediate family, and household members. Examples include Social Security number, home address, phone or email, bank or health data, and where they work or go to school. Penalties: class A misdemeanor; if bodily injury results it is a class C felony; substantial or serious injury is a class B felony; death is a class A felony. The law takes effect immediately.

Stronger harassment and 911 call rules

The law updates harassment rules to ban sharing someone’s personal identifying information to frighten or harass. It covers writing and posts on public websites and forums. Some listed harassment acts are class A misdemeanors; the rest under this section are class B misdemeanors. A crime by electronic message can be charged where it was sent or where it was received. It is also a crime to call 911 to annoy or harass, or to make a false report; one or more calls with no real emergency can show intent. If convicted, you must repay the costs of any unnecessary emergency response.
