The law sets money limits on claims against a city, county, or other local body. From July 1, 2023 to June 30, 2024, the per-person cap is $406,250 and the per-occurrence cap is $1,625,000. From July 1, 2024 to June 30, 2025, the caps are $437,500 and $1,750,000. From July 1, 2025 to June 30, 2026, the caps are $468,750 and $1,875,000. On and after July 1, 2026, the caps are $500,000 per person and $2,000,000 per occurrence. These limits apply no matter how many entities or employees are involved.
Local governments and their workers are not liable for many public decisions and actions. This includes lawmaking, rulemaking, and judicial or licensing acts. They are also immune for discretionary functions, even if those choices are abused. You generally cannot recover for inspections, enforcement, parole and probation work, ordinary police work, or ordinary fire protection. They are not liable for harm caused by people they do not employ.
You cannot get punitive or exemplary damages from a city or other local government. A local government also does not have to pay an employee’s punitive damages. Only compensatory damages are available, and those are still limited by the damage caps.
