Parents must approve and be told

Schools and teachers cannot set a policy about a student’s transgender status without the parent’s or guardian’s approval. They also cannot hide that information from the parent, unless another law requires it. A parent can file a complaint with the district, then with the North Dakota Attorney General if it is not fixed. The Attorney General can investigate, issue subpoenas, and seek court orders to stop violations. A court may fine a district, school, or teacher up to $2,500 per violation.

Restroom use must match biological sex

Public schools must stop students from using restrooms that do not match their biological sex. District boards must enforce this rule. For a transgender student, the board must set up a separate restroom plan with the parent’s or guardian’s approval.

Rules take effect immediately

This law is an emergency measure. It takes effect immediately upon enactment. Schools and districts must follow these rules now.

Schools ban multi-stall gender-neutral restrooms

Multi-stall restrooms and showers must be marked male-only or female-only, and used only by that sex. Boys’ and girls’ rooms cannot share a communal sink or shared entry area. This ban does not cover rooms that already existed on July 1, 2025. Students covered by IDEA, Section 504, or the ADA may use restrooms allowed by those federal rights, and schools may temporarily switch a room’s sex for a school event. If a school met the state toilet-per-student rule on January 1, 2025, it is exempt from that ratio when a required designation change would break it.

Schools cannot force or forbid pronouns

School boards, public schools, and teachers cannot make rules that force anyone to use a student’s preferred pronouns. They also cannot make rules that forbid someone from using a student’s preferred pronouns. This applies in all North Dakota public K‑12 schools.
