Four-year pause on senior care beds

From August 1, 2025 through July 31, 2029, North Dakota stops adding new basic care and nursing facility beds to the state’s licensed capacity. Basic care beds can still be added when a nursing home converts nursing beds to basic care, when capacity is transferred and licensed as basic care under state transfer rules, when an area lacks basic care or beds within 50 miles were 90% full for the past 12 months, or when the department approves new beds. When judging a shortage, the department may prefer entities that agree to serve people covered by Medicaid (Title XIX). Department-approved basic care beds must be licensed within 48 months of approval. For nursing homes, new beds are allowed only by reverting basic care beds back to nursing beds or by relicensing nursing beds that were delicensed after July 31, 2011.

Limits on nursing home bed changes

A nursing facility cannot change its licensed nursing bed count more than two times in any 12 months. Actions that count include delicensing or relicensing beds, switching nursing beds to basic care, switching basic care beds back to nursing, or any other reconfiguration.
