Cash for unused sick leave after 10 years

If you leave state employment with at least 10 continuous years, you get a lump-sum payment equal to 10% of the pay value of your unused sick leave. The value is one hour of pay for each unused sick hour, using your pay rate at separation. Service stays continuous if you return within two years after a reduction in force, or if you take unpaid leave up to two years for education or up to one year for other reasons. Your last employing agency pays this from its salary funds.

Set monthly leave accruals for state workers

Your agency must set your monthly leave accruals. For annual leave, you earn between 1 and 2 working days per month, based on your tenure or experience. Agencies may grant leave at hire within that range, and can give more than the normal tenure amount only for jobs listed as hard to fill under section 54-06-31 after meeting that section’s requirements. For sick leave, you earn between 1 and 1.5 working days per month, based on tenure. When you take annual or sick leave on a working day, you are paid your full pay. Each agency must adopt these leave rules and file them with the Office of Management and Budget.

State workers get 40 hours new-hire leave

Permanent state employees who are not under a written contract get 40 hours of new-hire leave at hire. You must use it in your first year; any unused hours are lost. This is not earned paid time off and is not paid when you leave state employment.
