Commission duties and meetings

The commission meets at least once every two years and elects a chair, vice chair, and secretary. The chair and secretary serve two years and continue until successors are elected. Each commissioner must attend the National Conference’s annual meeting. The commission works to promote uniform state laws and consistent court rulings. Between sessions, it can send model law proposals to Legislative Management and must report to the legislature every biennial session.

How commissioners are chosen and serve

The Attorney General appoints one member, and that member’s term ends when that Attorney General’s term ends. The Governor appoints most other members to four‑year terms that start on September 1 after each presidential election and continue until a successor is appointed. Legislative Management appoints the House and Senate members for up to two years. The chair of Legislative Management appoints the Legislative Council member. All commissioner terms begin on September 1.

No pay, but expense reimbursements for commissioners

Commissioners serve without pay, except members of the legislative assembly may be paid under section 54‑03‑20. Appointed commissioners and elected life members can get necessary expenses reimbursed at state travel rates, from funds set aside for that purpose. Commissioners included only because of five years of prior service cannot be reimbursed unless they have at least 20 years in the legislature. To receive payment, a commissioner submits a voucher, and the Office of Management and Budget issues the check.

Who can serve on the Commission

The commission includes a North Dakota–licensed attorney, a UND law dean or full‑time faculty member, a law‑trained judge, a House member, a Senate member, and a Legislative Council member. It also may include elected life members of the National Conference and residents who have served at least five years before. All commissioners must live in North Dakota, except elected life members; anyone first appointed after July 21, 2011 must be a resident. At first appointment, a person must be a licensed attorney in good standing with the state bar. If a legislator is not eligible to serve, Legislative Management may appoint another eligible person.
